Oppose SB 46 – Keep Lawful Residents in Their Homes

The Issue

The Maryland Senate recently passed SB 46, which threatens to evict lawful residents in as little as four days after a complaint is filed. This bill isn’t just about squatters – it risks displacing Marylanders who are lawful tenants, victims of rental scams, or survivors of domestic violence. SB 46 will be heard in the House Judiciary Committee on Tuesday, March 25, 2025.

Why SB 46 is Dangerous:

  • Rushed Evictions: This bill allows trials only 4 days after a complaint is filed, giving residents little time to get legal help or even receive notice of the court date.

  • Shortened Appeal Window: This bill cuts the appeal period to just 4 days and permits evictions immediately after judgment – even if the appeal period isn’t over.

  • Unfair Court Orders: This bill lets courts require residents to pay the plaintiff even if they were never notified about the case.

  • No Proof Required: This bill sets a precedent that the plaintiff doesn’t have to prove their case if the resident doesn’t appear in court.

Without proper notice and a chance to be heard, our legal system becomes about power instead of justice. Urge the house judiciary committee to vote NO on SB 46.
